These Terms of Service ("Terms") govern your use of the DonzHit.me website, mobile application, and related services (collectively, the "Service") operated by DonzHit LLC, a Texas Limited Liability Company ("DonzHit," "we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Account & Authentication

The Service uses Google Sign-In for authentication. You are responsible for all activity that occurs under your account. You agree to keep your credentials secure and to notify us immediately of any unauthorized use.

3. User-Submitted Content

The Service allows you to submit videos, photographs, and descriptions of traffic or pedestrian incidents ("Content"). By submitting Content you represent and warrant that:

• You are the owner of the Content or have all rights necessary to grant the license below.
• The Content depicts a real incident and is not fabricated, altered, or misleading.
• The Content does not violate any applicable law or the rights of any third party.
• You have not included personal information (e.g., faces, license plates) in a manner that would constitute unlawful doxxing or harassment.

You retain ownership of your Content. By submitting Content you grant DonzHit LLC a worldwide, royalty-free, non-exclusive license to host, display, distribute, and (where applicable) upload your Content to third-party platforms such as YouTube in connection with operating the Service.

4. Content Review & Moderation

All submitted Content is reviewed by DonzHit administrators before being made publicly visible. We reserve the right to reject, remove, or modify any Content at our sole discretion, including Content that is off-topic, misleading, abusive, illegal, or otherwise inconsistent with the purpose of the Service.

5. Prohibited Uses

You agree not to:

• Submit false, fabricated, or maliciously edited Content.
• Use the Service to harass, threaten, or harm any individual.
• Attempt to reverse-engineer, scrape, or disrupt the Service.
• Upload Content that contains malware, spam, or illegal material.
• Use the Service for any commercial purpose without our prior written consent.

6. Third-Party Services

The Service integrates with third-party services including Google Maps, YouTube, and Firebase. Your use of those services is subject to their respective terms and privacy policies. DonzHit LLC is not responsible for the practices of any third-party service.

7. Intellectual Property

The DonzHit.me name, logo, and all Service-related software, design, and text (excluding user-submitted Content) are the property of DonzHit LLC and are protected by copyright and trademark law. "DonzHit" and "DonzHit.me" are trademarks of DonzHit LLC.

8. Copyright & DMCA Takedown Policy

DonzHit LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that Content on the Service infringes your copyright, please submit a written notice to our designated DMCA agent containing all of the following:

• A physical or electronic signature of the copyright owner or an authorized agent.
• Identification of the copyrighted work you claim has been infringed.
• Identification of the material on the Service that you claim is infringing, with sufficient detail to locate it (e.g., a URL).
• Your contact information (name, address, telephone number, and email address).
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing Content and notify the user who submitted it.

Counter-Notice: If you believe your Content was removed in error, you may submit a counter-notice to our DMCA agent containing: your signature; identification of the removed Content and its prior location; a statement under penalty of perjury that you have a good-faith belief the Content was removed by mistake or misidentification; your name, address, and phone number; and your consent to the jurisdiction of the federal district court for your district. Upon receipt of a valid counter-notice, we may restore the Content after 10–14 business days unless the complaining party seeks a court order.

Repeat Infringers: We will terminate the accounts of users who are repeat copyright infringers.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DONZHIT LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless DonzHit LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service at any time. Sections 3, 7, 8, 9, 10, 11, and 13 of these Terms will survive any termination.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

14. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DonzHit LLC regarding the Service and supersede all prior agreements.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
